General Terms and Conditions of Sale

1. Introduction

These general terms and conditions of sale (hereinafter the "GTC") define the reciprocal rights and obligations in the event of the purchase of products or services on by a User (hereinafter "Customer"). The GTC express all the obligations of the parties. The Customer is deemed to accept them without reservation, otherwise his order will not be validated. The provisions of the GTC may exceptionally be waived to the extent that these derogations have been the subject of a written agreement. These derogations may consist of the modification, addition or deletion of the clauses to which they relate and have no impact on the application of the other provisions of the GTC. The Customer who wishes to make a purchase certifies that he is authorized to do so. Persons who are declared unfit under the provisions of Articles 1123 et seq. of the Civil Code may under no circumstances make purchases. The Parties agree that the legal relationships that exist between them are exclusively governed by these general conditions of sale. If a rule is missing, reference will be made to the legal requirements for "distance selling" applied by the Belgian Law of 21 December 2013 inserting Title VI "Market practices and consumer protection.

Monsieur Trottinettes reserves the right to modify the GTC from time to time. The changes will be applicable as soon as they are posted online for any purchase after this date.

2. Purpose

These conditions apply to online sales by MONSIEUR TROTTINETTES. These conditions are intended to define the terms of sale between MONSIEUR TROTTINETTES and the Customer with regard to the request for quotation, order, payment and delivery. They define the steps necessary to place an order and guarantee the follow-up of this order between the contracting parties.

3. Products and Services

The products offered are those listed on the website of the company MONSIEUR TROTTINETTES, within the limits of available stocks. The MONSIEUR TROTTINETTES company reserves the right to change the product assortment at any time. Each product is presented on the website in the form of a description containing its main technical characteristics (capacity, use, composition, etc.). The photographs are as faithful as possible but do not bind the Seller. The sale of the products presented in the site is intended for all buyers residing in Europe.

4. Prices

The prices appearing on the product sheets of the catalog are prices in Euros (€) all taxes included (TTC) taking into account the applicable VAT.   MONSIEUR TROTTINETTES reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased according to the total amount of the order. Shipping costs vary depending on the country of the recipient. 

5. Order and payment

Before any order, the buyer must create an account on the site The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wishes to order or consult his account (order status, profile ...), must identify himself using this information. The company MONSIEUR TROTTINETTES offers the buyer to order and pay for its products in several different ways (Bancontact, VISA, credit card, SOFORT ...). The confirmation of an order implies acceptance of these conditions of sale, the acknowledgement of having perfect knowledge of them and the waiver of its own conditions of purchase. All the data provided and the recorded confirmation will be proof of the transaction. If the buyer has an email address and if he has entered it on his order form, the company MONSIEUR TROTTINETTES will send him by email the confirmation of the registration of his order. 6. Withdrawal

Further to DIRECTIVE 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, amending Council Directive 93/13/EEC and Directive 1999/44/EC of the European Parliament and of the Council and repealing Council Directive 85/577/EEC and Directive 97/7/EC of the European Parliament and of the Council, The buyer has a period of fourteen working days from the delivery of their order to exercise his right of withdrawal and thus return the product to the seller for exchange or refund without penalty, with the exception of return costs.

8. Warranty

All products supplied by the company MONSIEUR TROTTINETTES benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-compliance of a product sold, it may be returned to the MONSIEUR TROTTINETTES company  which will take it back, exchange it or refund it. 9. Liability

The company MONSIEUR TROTTINETTES, in the process of distance selling, is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service, or other involuntary problems. The responsibility of MONSIEUR TROTTINETTES can not be engaged for damage resulting from the use of the scooter such as accident on the road, damage, speed increase (flash) or other involuntary problems due to a scooter or the placement of a part sold at MONSIEUR TROTTINETTES.

10. Intellectual property

All elements of the site are and remain the intellectual and exclusive property of the company MONSIEUR TROTTINETTES. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text.

11. Personal data

The company MONSIEUR TROTTINETTES undertakes to preserve the confidentiality of the information provided by the buyer, which he would be required to transmit for the use of certain services.
